40th Meeting

On 8 May 2025, the Board of the Croatian Financial Services Supervisory Agency held its 40th meeting and adopted the following decisions of public interest:

1. Official position on the application of the consumer protection regulatory framework to life insurance policy loans
2. Decision on compliance with the Guidelines on the procedures and policies, including the rights of clients, in the context of transfer services for crypto-assets under the Markets in Crypto Assets Regulation (MiCA) on investor protection (ESMA35-1872330276-2032)
3. Decision on compliance with the Guidelines on certain aspects of the suitability requirements and format of the periodic statement for portfolio management activities under MiCA (ESMA35-1872330276-2031)
4. Decision on compliance with the Guidelines on situations in which a third-country firm is deemed to solicit clients established or situated in the EU and the supervision practices to detect and prevent circumvention of the reverse solicitation exemption under the Markets in Crypto Assets Regulation (MiCA) (ESMA35-1872330276-2030)
5. Decision on compliance with the Guidelines on the specification of Union standards for the maintenance of systems and security access protocols for offerors and persons seeking admission to trading of crypto-assets other than asset referenced tokens and e-money tokens (ESMA75-223375936-6132)
6. Decision on compliance with the Joint Guidelines on templates for explanations and opinions, and the standardised test for the classification of crypto-assets, under Article 97(1) of Regulation (EU) 2023/1114 (JC 2024 28)
7. Decision on compliance with the Joint Guidelines on the estimation of aggregated annual costs and losses caused by major ICT-related incidents under Regulation (EU) 2022/2554 (JC 2024 34)
8. Decision granting approval to the company ATLANTIC GRUPA d.d., Zagreb, Miramarska cesta 23, OIB: 71149912416, LEI: 3157002G3ENYCZEB1A25, for a simplified prospectus relating to the public offering of bonds of total nominal amount reaching EUR 80,000,000.00, with a denomination of EUR 1.00 and a fixed annual interest rate with semi-annual interest payments and a one-time principal maturity 5 (five) years after the date of their issue and admission to the regulated market
9. Decision granting authorisation to Grgo Dodig from Baška Voda to perform the function of a member of the Supervisory Board of the company EUROHERC osiguranje d.d., Zagreb, OIB: 22694857747, LEI: 74780000Q0NHK2O5DU16, for a term of office lasting 4 (four) years, running as of 20 July 2025

19. Decision determining that the authorisation to conduct insurance distribution business issued on 30 November 2018 to Davorka Kresoja from Zagreb, founder of the insurance representation craft DZO-ZASTUPANJE, OBRT ZA ZASTUPANJE U OSIGURANJU, VL. DAVORKA KRESOJA I MIROSLAV LUZAR, ZAGREB, RADOSLAVA CIMERMANA 36 A, craft registration number (MBO): 97943258, by virtue of a Decision of the Croatian Financial Services Supervisory Agency, ceased to be valid on 7 April 2025; and determining that the name of the insurance representation craft referred to in point 1 now reads: DZO-ZASTUPANJE, OBRT ZA ZASTUPANJE U OSIGURANJU, VL. 20. Decision determining that the authorisation to conduct insurance distribution business issued on 28 January 2010 to the company ENARGIT ZASTUPANJE d.o.o. za usluge, with its registered office in Zagreb, Ulica Stjepana Ljubića Vojvode 4, OIB: 62737106538 (ex ENARGIT ZASTUPANJE d.o.o. za zastupanje u osiguranju, with its registered office in Sesvete, Ivana Brkanovića 1), represented by Ines Ivančan Županac, Managing Director of the Company, by virtue of Hanfa’s s Decision, ceased to be valid on 18 March 2025
21. Decision determining that the authorisation to conduct insurance distribution business issued on 11 March 2021 to Biserka Friščić from Nedeljanec, founder of the insurance representation craft BE FREE, obrt za zastupanje u osiguranju, vl. Biserka Friščić, Nedeljanec, Braće Radića 35, by virtue of Hanfa’s Decision, ceased to be valid on 30 April 2025
